Countervailing Duties Act

A countervailing duty is a special tariff imposed on exports subsidized by a foreign government to offset the benefits of that government subsidy, and is levied in addition to regular tariffs. Article 8 of the Customs Tariff Act stipulates that a countervailing duty may be imposed if a foreign government directly or indirectly subsidizes the production or export of an export item, and the resulting export causes substantial injury to a competing domestic industry in Japan. The idea behind this is that trade should be conducted freely without state intervention, but since it is unfair for the exporting government to provide export subsidies, the importing country imposes a countervailing duty in response.

外国政府の補助付輸出に対して，その政府補助の利益を相殺するために課す特別関税で，通常の関税に付加して課税される。関税定率法8条に，外国政府が輸出品の生産または輸出について直接または間接に補助金を交付し，これによる輸出の結果，日本の競合する国内産業に実質的損害が生ずる場合，相殺関税を課することができると規定されている。これは，本来貿易は国家の関与なく自由に行われるべきものであるが，輸出国政府が輸出補助金を支出するのは不公正であるので，これに対して輸入国が相殺関税を課すという趣旨である。
