A person who is mentally impaired (a person who lacks normal judgment capacity, but not to the level of insanity) or who has a tendency to spendthrift, and who has been declared quasi-incompetent by a family court following a certain procedure. A type of person with limited legal capacity until the 1999 Civil Code amendment (→ Legal Capacity). With the amendment, the term quasi-incompetent was abolished, and people are now classified as persons under guardianship (→ Guardianship) or assistance (→ Assistance) depending on the degree of their lack of judgment capacity (→ Adult Guardianship System). In addition, since there has long been criticism of restricting the legal capacity of spendthrifts, the amendment means that they are no longer subject to guardianship. 心神耗弱者(心神喪失ほどではないが正常な判断能力を欠く者)または浪費癖のある者で,一定の手続きに従い家庭裁判所で準禁治産の宣告を受けた者。1999年の民法改正までの制限行為能力者の一種(→行為能力)。改正により準禁治産者という呼称は廃止され,判断能力の欠如の程度に応じて被保佐人(→保佐)と被補助人(→補助)に分類されることになった(→成年後見制度)。また,浪費者については以前から,行為能力を制限することに批判が多かったことから,同改正により,保佐の対象としないことになった。(→禁治産者)
