Objection to execution/Appeal against execution

Japanese: 執行異議･執行抗告 - しっこういぎしっこうこうこく

A means of appeal against each individual execution disposition made by the enforcement agency. For example, if an execution officer seizes movable property that is prohibited from being seized under Article 131 of the Civil Execution Act, or if an execution court issues an order to seize a claim ignoring a decision to suspend execution, these seizures and seizure orders are considered procedurally illegal, and relief is granted through an objection to execution or an appeal against execution. In that the subject of the appeal is limited to individual dispositions, it is distinguished from a "suit for objection to a claim," which challenges the claim right that is the basis of execution, and a "suit for objection to the issuance of a writ of execution," which challenges the existence of the enforcement power itself.

強制執行をする機関が行う各個の執行処分に対する不服申立手段。たとえば，民事執行法131条によって差押えを禁止されている動産について執行官が差押えを行った場合，あるいは執行停止決定を無視して執行裁判所が，債権の差押命令を発した場合，これらの差押えや差押命令は，いずれも手続的に違法なものとされ，執行異議または執行抗告による救済が認められる。不服の対象が個別の処分に限られる点で，執行の基本となる請求権そのものについて争う〈請求異議の訴え〉や，執行力そのものの存在を争う〈執行文付与に対する異議の訴え〉と区別される。
