International Economic Law
Law that regulates economic phenomena (international economy) that unfold across borders. After World War II, the international economy developed dramatically under the Bretton Woods system, which was established under the initiative of the United States with the aim of liberalizing goods, capital, and services, and the laws that regulate it also developed rapidly. However, the academic systematization of international economic law has only just begun, and there are conflicting theories on the concept. While there is a position that considers only the international law that regulates the international economy (public international law) to be international economic law (G. Schwarzenberger), there is also a powerful position that considers the international law that regulates the international economy and the domestic public law that regulates foreign economic relations to be international economic law together (Eller, Petersmann).

国境を越えて展開する経済現象 (国際経済) を規律する法。第2次世界大戦後,商品・資本・サービスの自由化を目指してアメリカ合衆国の主導で構築されたブレトンウッズ体制のもとで国際経済は飛躍的に発展し,これを規律する法も急速な発展をとげてきた。しかし国際経済法の学問的体系化は端緒についたばかりで,その概念については学説が対立している。国際経済を規律する国際法 (国際公法) のみを国際経済法ととらえる立場 (G.シュバルツェンバーガー) がある一方,国際経済を規律する国際法と対外経済関係を規律する国内公法をあわせて国際経済法ととらえる立場も有力に主張されている (エルラー,ペータースマン) 。
