In a broad sense, it means all property owned by local governments, but under the Local Autonomy Act, public property includes real estate such as land and buildings, movable property such as ships and aircraft, usufruct rights such as surface rights and easements, intangible property rights such as patents and copyrights, and securities. The Local Autonomy Act, like the National Property Act, distinguishes public property into administrative property and ordinary property. Administrative property refers to property that is used or has been decided to be used for public or public purposes by local governments, while ordinary property refers to all public property excluding administrative property. Ordinary property can be the subject of transactions under private law, but administrative property, due to its purpose of being used for public or public purposes, is generally not permitted to be loaned, exchanged, sold, etc.

広義では、地方公共団体の所有するすべての財産を意味するが、地方自治法では、この地方公共団体に属する財産のうち、土地・建物などの不動産、船舶・航空機などの動産、地上権・地役権などの用益物権、特許権・著作権などの無体財産権および有価証券などの財産が公有財産と称されている。地方自治法は、国有財産法の場合と同様に、公有財産を行政財産と普通財産とに区別する。行政財産とは、地方公共団体において公用または公共用に供し、または供するものと決定された財産をいい、普通財産とは、この行政財産を除いたすべての公有財産をいう。普通財産は私法上の取引の対象とされうるが、行政財産については、公用または公共用に供するというその目的からして、これを貸し付け、交換し、売り払うなどの行為は原則として認められていない。
