Pollution compensation system
Damage caused by pollution can sometimes involve damage to health and the body, including life, as seen in the case of Minamata disease, but can also involve property damage mainly to primary industries such as agriculture, fishing, and forestry, as well as property damage to the homes of ordinary residents. In addition, there can also be damage to the broader environment and ecosystems, and intangible damage to landscapes and culture. However, compensation for these damages only becomes an issue when a specific victim can be identified, and further, only when the perpetrator of the damage to the victim is clear.

公害による被害は,水俣病等にみられるように,ときには生命を含む健康・身体への被害もあれば,主として農業・漁業・林業等の第1次産業に係る財産的被害,また一般住民の住宅への財産的被害などがある。さらに,広く自然や生態系への被害や,景観・文化などへの無形の被害も考えられる。しかし,これらに対する損害賠償が問題となるのは,特定の被害者を確定できる場合であり,さらに当該被害者に対する加害者が明らかな場合に限られる。
