An act that violates criminal laws enacted for the purpose of preventing pollution. In theory, it raises issues regarding negligence, criminal liability of corporations, causation, etc. There are various forms of pollution prevention through criminal provisions, and the nature of the violations is also diverse. In terms of legislative theory, there is no consensus on what types of violations are appropriate and effective to be subject to criminal punishment. Current laws generally implement the following types of gradual regulation. First, the act that caused the damage is punished at the point when damage actually occurs to a person's life or body.

公害の防止を目的として制定された刑罰法規に違反する行為。理論上，過失，法人の刑事責任，因果関係等に問題を提起している。刑罰規定による公害の防止には種々の態様があり，その違反の性質も種々である。立法論として，どのような内容の違反行為を刑罰の対象とするのが適当かまた効果的かについて，見解は一致しない。現行法は，おおむね次のような態様の段階的規制を行っている。　第1に，現実に人の生命･身体に被害が発生した時点で，被害を発生させた行為を処罰している。
