Auction - Versteigerung
A transaction in which many people bid competitively and then the property is sold to the highest bidder. (1) When an auction is conducted by a national agency, it is called a public auction or public sale. Compulsory execution of real estate for monetary claims can be carried out by a public auction, which is called a compulsory auction. (2) In the narrow sense, it means an auction as an enforcement of a security interest under Chapter 4 of the Civil Execution Act. (3) Pro forma auction An auction conducted in accordance with the provisions of the Civil Execution Act, based on the application of a person who wishes to conduct an auction in accordance with the provisions of the Civil Code or Commercial Code (Article 195). It is conducted to convert the subject matter into cash for the purpose of storing or organizing assets. For example, there are auctions for the division of co-owned property (Civil Code Article 258, Paragraph 2), auctions for the payment deposit of the payer (Civil Code Article 497, Non-Contentious Cases Procedure Law Article 83), and auctions based on self-help sales in commercial transactions between merchants (Commercial Code Articles 524, 527, Non-Contentious Cases Procedure Law Article 126, Paragraph 5). In these types of auctions, the role of the auction organization ends with the sale of the property, and is unrelated to the satisfaction of claims or the realization of responsibilities. However, procedurally, these are conducted in accordance with the provisions of the Civil Execution Law, and are therefore generally referred to as formal auctions.

多数人が競争で値づけをし,そのなかの最高価買受け申出人に売却する方法で行う売買。 (1) 競売を国家機関が行う場合,これを公の競売または公売という。金銭債権についての不動産強制執行は,公の競売によることができるが,これを強制競売という。 (2) 狭義では民事執行法第4章の担保権実行としての競売を意味する。 (3) 形式的競売 民法または商法の規定によって競売をしようとする者の申立てに基づき,民事執行法の定めによってする競売 (195条) 。財産の保管または整理などの目的をもって,その目的物を換価するために行われる。たとえば,共有物分割のためにする競売 (民法 258条2項) ,弁済者の弁済供託のための競売 (民法 497,非訟事件手続法 83) ,商人間に行われる商事売買の自助売却に基づく競売 (商法 524,527,非訟事件手続法 126条5項) などである。この種の競売では,競売機関の任務は換価をもって終了し,請求権の満足とか責任の実現などとは無関係である。ただ手続法上,民事執行法の規定に準拠してされるため,一般に形式的競売と呼ぶのである。
