Administrative Penalty - gyoseibatsu

Sanctions imposed for violations of administrative obligations. Sanctions imposed for past violations of obligations, and although they indirectly have the effect of exerting psychological pressure on the obligor not to commit or continue to violate the obligation, they are not a means of directly achieving the fulfillment of the obligation, as is the case with administrative coercion. They are broadly divided into administrative penalties, which impose penalties with names in the Criminal Code (imprisonment, incarceration, fines, detention, and minor fines; Article 9 of the Criminal Code), and administrative penalties, which impose sanctions in the form of non-penal fines for minor violations. Disciplinary actions against public officials are also sometimes called administrative penalties.

行政上の義務違反に対して科せられる制裁。過去の義務違反に対して科せられる制裁であり、間接的には義務者に、義務違反を犯し、または継続することのないよう心理的圧力を加える効果を有するが、行政強制のように義務の履行を直接に実現する手段ではない。刑法に刑名のある刑罰（懲役、禁錮、罰金、拘留、科料。刑法9条）を科す行政刑罰と、軽微な違反行為に対して過料という制裁を科す秩序罰とに大別される。なお、公務員に対する懲戒処分も行政罰といわれることがある。
