A new field of modern law that is being formed as a legal system with its own legal logic that promotes education. Although the exact definition of the concept has not yet been determined, typical definitions include "a system of legal logic unique to the education system" (Kaneko Hitoshi, Educational Law (New Edition), 1978) or "a legal system that socially controls the conditions of the human learning process and ensures human development" (Maki Masana and Hirahara Haruyoshi, eds., Introduction to Educational Law, 1975). As is typical in the UK and Germany, legal provisions related to education first appeared in factory laws and general administrative laws, but it was not until the late 19th century, when the modern public education system, especially the legal system for compulsory education, was established, that an independent set of educational laws was enacted. 教育を助長する固有な法論理をもつ法体系として形成されつつある新しい現代法の一分野。厳密な概念規定はなお確定しているとはいえないが,〈教育制度に特有な法論理の体系〉(兼子仁《教育法(新版)》1978),あるいは〈人間の学習過程の条件を社会的に統制し,人間の発達を保障する法体系〉(牧柾名・平原春好編《教育法入門》1975)などが代表的な定義である。イギリスやドイツに典型的にみられるように,教育にかかわる法条項は工場法や一般行政法のなかに初めて登場するが,独立した一連の教育法規として制定されるのは,近代公教育制度とりわけ義務教育法制が確立してくる19世紀後半以降である。
