...When an appeal is made, the entire judgment of first instance is prevented from becoming final, but an actual adjudication is made only to the extent of the parties' appeal. Therefore, with regard to the parts of the judgment of first instance that are not the subject of an appeal by either party, the appellate court may, upon application, declare provisional execution (Article 294).
[Sanctions for abuse of the right to appeal]
When dismissing an appeal, if the appellate court finds that the appellant filed the appeal with the sole purpose of delaying the completion of the lawsuit, it may impose sanctions by ordering the appellant to pay a sum of not more than 10 times the amount that would have been paid as the fee for filing the appeal (judgment to pay money) (Article 303).

During the appeal process, the appellee files a petition to assert his/her dissatisfaction with the first instance judgment and to expand the scope of the appeal judgment in his/her favor.
