...If the fetus that has been expelled from the mother's body is still alive, the act of killing it constitutes a new crime of murder, and the two crimes become a consolidated crime (case law). There are two types of abortion: self-abortion by the pregnant woman herself (Article 212 of the Penal Code, imprisonment of up to one year), consensual abortion performed at the request of the pregnant woman or with her consent (Article 213, imprisonment of up to two years), professional abortion performed by a doctor, midwife, etc. with the pregnant woman's consent (Article 214, imprisonment of between three months and five years), and non-consensual abortion performed against the pregnant woman's will (Article 215, imprisonment of between six months and seven years). In cases of abortion crimes other than self-abortion by the pregnant woman, the penalty is increased if the pregnant woman is killed or injured.
