A type of accident compensation. Compensation in which an employer pays a certain percentage of a worker's wages during the period of recuperation to a worker who is absent from work due to a work-related injury or illness. In Japan, Article 76 of the Labor Standards Act stipulates that 60% of the average wage shall be paid. However, Article 78 of the same act stipulates that if the Chief of the Labor Standards Inspection Office certifies that the accident was caused by the worker's gross negligence, compensation for absence from work does not have to be paid. In addition, if an employee is unable to return to work after three years have passed since the start of the leave, a certain amount of severance compensation will be paid and the right to compensation will be lost (Article 81). In addition, if an employer is covered by Workmen's Accident Compensation Insurance (Workmen's Accident Compensation Insurance), the employer only needs to pay compensation for absence from work for the first three days of the leave, and the same amount will be paid from the Workmen's Accident Compensation Insurance for the rest of the leave (Workmen's Accident Compensation Insurance Act, 14). 災害補償の一つ。業務上の負傷,疾病のため休業する労働者に対して,使用者がその療養期間中賃金の一定割合を支払う補償。日本では労働基準法 76条において,平均賃金の 60%を支給することとしている。ただし同法 78条では,労働者の重大な過失による災害であることを労働基準監督署長が認定した場合には,休業補償を行わなくてもよいとされている。また休業開始後3年を経過しても復帰できない場合は,一定の打切補償が行われ,補償の権利は失われる (81条) 。なお使用者が労働者災害補償保険 (労災保険) に加入している場合,使用者は休業当初の3日間のみの休業補償を行うだけでよく,あとは労災保険から同額が支給されることとなっている (労働者災害補償保険法 14) 。
