"Common Law Theory" - Kanshu Horon

…After graduating from the universities of Munich, Leipzig, and Marburg, he became professor at the University of Berlin as Savigny's successor in 1842. His two-volume work Das Gewohnheitsrecht (1828, 37) is said to have promoted the necessary transition from the stage in which all members of a nation participate in the formation of law to the stage in which legal formation is dominated by professional lawyers, based on the romantic national spirit of historical jurisprudence, using the historical-philosophical dialectics of Fichte and Hegel, in the form of a theory of the sources of law. His other major works, the Lehrbuch der Pandekten (1833) and the three-volume Curriculum der Institutionen (1841-47), were later criticized by the jurisprudence of interests as using "inversion," but they established the foundations of the later "jurisprudence of concepts," which extracts dogmatic propositions from concepts.
