…However, by the 16th century, the jurisdiction of the Court of Chancery had become so broad that conflicts of jurisdiction arose frequently, thus infringing on the professional interests of the common law lawyers, who were parasitic on the common law. This alliance broke down in the 16th and 17th centuries, and the two sides frequently fought each other, due in part to political struggles between the absolute monarchy and its opponents. In particular, the clash between E. Cooke, the leader of the supporters of the common law and anti-absolute monarchy side, and Lord Ellesmere and F. Bacon, the Lord Chancellor, is famous. However, the resulting King's decision (1616) finally confirmed the authority of the Court of Chancery, and after the temporary crisis of the Revolutionary period, its existence flourished unthreat after the Restoration (1660). As the Court of Chancery was established in this way, even if it respected specificity, giving different judgments to many similar cases would be itself against equity, and custom and case law were created based on the accumulated precedents. …

…しかし大法官府裁判所が16世紀までにその管轄をきわめて広くしたために，管轄が衝突する場合が多くなり，かくしてコモン･ローに寄生するコモン･ロー法曹の職業的利益が侵されることにもなり，絶対王政とその反対派との政治的争いもからんで，16,17世紀にはこの提携関係が崩れ，両者はしばしば闘争を繰り返した。特にコモン･ロー支持，反絶対王政側のリーダーであるE.クックと大法官エルズミアLord EllesmereおよびF.ベーコンとの激突は有名であるが，その結果の国王の裁定(1616)により，大法官府裁判所の権能は最終的に確認され，革命期の一時的危機の後，王政復古(1660)以後はその存在は脅かされることなく隆盛となった。　このように大法官府裁判所が確立されてくると，いかに具体性を尊重するとはいえ，多数の類似の事件に異なった判決を与えることはそれ自体が衡平に反することになり，ここに集積された判例を中心にした慣行･判例法が生じてくる。…
