...Because a trader uses a name to clearly indicate his or her identity, it is different from a trademark used to indicate one's own goods or a service mark used for services not related to goods. It is also different from a business mark used to indicate the identity of a trader's business (such as the Mitsukoshi department store mark). Since a trade name is a name, it must be able to be displayed in characters and pronounced; a simple symbol or figure may be a trademark, but it is not a trade name.
