Japan's Maritime Transportation Act (promulgated in 1949) defines it as "a business that acts as an intermediary in the maritime transportation of goods, or the leasing, buying and selling, or entrustment of the operation of ships" (Article 2, Clause 9). As in the general commodity market and stock market, there are middlemen (shipping brokers) in the shipping market who play an important role in shipping transactions. Although there are cases where shipping companies negotiate directly with shippers (especially in long-term contracts for dedicated ships), the more common and traditional method is for a middleman to be involved between the two parties and make the arrangement. 日本の海上運送法(1949公布)では,〈物品海上運送又は船舶の貸渡,売買若しくは運航の委託の媒介をする事業をいう〉(2条9項)と規定されている。一般商品市場や株式市場などの場合と同様に,海運市場にも仲立人(海運ブローカー)が存在し,海運取引に重要な役割を果たしている。海運企業が荷主と直接交渉して取引する方法もあるが(とくに専用船の長期契約において),両者の間に仲立人が介在して取り決められるのがより一般的かつ伝統的な方法である。
