…The concept of an appeal lawsuit was originally formed as an academic term in close connection with the administrative court system. In the past, before the establishment of the modern administrative court system in Germany, an appeal was a petition to a higher government agency against a disposition or decision of a lower government agency, and after the establishment of the administrative court system, a lawsuit challenging the validity of a disposition of a lower administrative agency came to be called an appeal lawsuit (Anfechtungsklage). Even under the prewar Japanese administrative court system, lawsuits challenging the validity of administrative actions, especially lawsuits seeking the cancellation of administrative actions, were called appeal lawsuits in academic circles. …
