Possession - Ryochi

It refers to a disposition by an investigative agency to take possession of property left behind by a suspect, etc., or property voluntarily handed over by the owner, possessor, or custodian (Article 221 of the Code of Criminal Procedure). In addition, a similar disposition by a court regarding property left behind by a defendant, etc., or property voluntarily handed over by the owner, possessor, or custodian (Article 101 of the same Code) is also called seizure. Since it applies to property left behind or voluntarily handed over, a warrant is not required. However, once possession is acquired, the effect is the same as seizure. Therefore, even if a request is made to return an item that has been voluntarily handed over, it does not have to be returned unless a return procedure is followed.

捜査機関が、被疑者等が遺留した物、または所有者・所持者・保管者が任意に提出した物の占有を取得する処分をいう（刑事訴訟法221条）。また、裁判所が、被告人等が遺留した物、所有者・所持者・保管者が任意に提出した物について行う同様の処分（同法101条）も領置である。遺留物または任意に提出された物が対象となるので、令状を必要としない。しかし、占有取得後の効果は差押えと変わらない。したがって、任意に提出された物についてその返還を求められても、還付手続による場合以外、返す必要はない。
