When the "Cold War" that followed World War II gave rise to the Korean War in 1950, the Second World Conference for the Defense of Peace called on all nations to enact laws to defend peace, which would punish war propaganda. In response, socialist countries enacted a succession of peace defense laws between 1950 and 1951. In the Soviet Union, the "Law on the Defense of Peace" was enacted on March 12, 1951, which stated that war propaganda in any form destroys the cause of peace and creates the threat of a new war, and is therefore a grave crime against humanity, and stipulated that those responsible for war propaganda must be brought before a court and tried as criminals with the most serious criminal record.

第2次世界大戦後の〈冷たい戦争〉状態が，1950年に朝鮮戦争をよびおこしたとき，第2回世界平和擁護大会は，戦争宣伝の処罰を内容とする平和擁護法の制定を各国によびかけた。これにこたえて，社会主義諸国は1950年から51年にかけて，相次いで平和擁護法を制定した。ソ連邦では，1951年3月12日に〈平和擁護に関する法律〉が制定されたが，そこでは，いかなる形式であれ，戦争の宣伝は，平和事業を破壊し，新しい戦争の脅威を生み出し，それゆえに，人類に対する重大な犯罪であるとしたうえで，戦争宣伝について責任のある者は，裁判所に送致され，最も重い刑事犯罪人として裁かれなければならないと規定された。
