When establishing a radio station, a license must be obtained from the Minister of Posts and Telecommunications under the provisions of the Radio Law, except for radio stations that emit weak radio waves below a certain level and public radio stations. Radio stations that violate this provision and are established without a license are called illegal radio stations, and radio waves emitted from such stations are illegal radio waves. Radio waves, which are a valuable resource shared by all humankind, have the property of propagating through space like light and sound, and are limited in number, so if they are left unchecked, they will interfere with each other and become unusable. Therefore, internationally, the International Telecommunication Convention stipulates frequency allocation, technical standards for radio equipment, and operating methods for radio stations, and in Japan, radio waves are regulated by the Radio Law. 無線局を開設するときは,発射する電波が一定のレベル以下の微弱な無線局および市民ラジオの無線局を除き,電波法の規定に基づき郵政大臣の免許を受けなければならない。この規定に違反して,免許を受けずに開設された無線局を不法無線局といい,これから発射される電波が不法電波である。電波は,光や音と同じように空間を伝播していく性質があること,また有限なものであることから,これを野放しにしておくと人類共有の貴重な資源である電波が互いに混信して使えなくなってしまうため,国際的には国際電気通信条約によって,周波数の割当て,無線設備の技術基準,無線局の運用方法等が取り決められているのを受けて,日本では電波法により電波の監理が行われている。
