Right of asylum

Asylum is a refuge given by a state to those who are being pursued, and the protection it provides. Asylum can be divided into territorial asylum, given within a state's own territory, and extraterritorial or extraterritorial asylum (also called diplomatic asylum), given at a state's overseas embassies or warships. The legal basis for the former is the territorial sovereignty of a state, while the latter is the extraterritoriality of overseas embassies and the like. Therefore, the latter is not generally recognized under international law. The right of asylum is the right of a state to grant such protection, but from the individual's perspective, it can also be considered the right to seek such protection, and in that sense it can also be called the right of exile.

庇護は、追われている者に対して国家によって与えられる避難所であり、そこで与えられる保護である。庇護は、自国の領域内で与えられる領域内（または領域的）庇護territorial asylumと、自国の在外公館や軍艦などで与えられる領域外庇護exterritorial or extraterritorial asylum（外交的庇護ともいう）とに分けられる。法的根拠は、前者が一国のもつ領域主権であるのに対し、後者が在外公館などのもつ治外法権性extra- or ex-territorialityである。したがって、後者は国際法上一般には認められていない。庇護権は、こうした庇護を国家が付与する権利であるが、個人の側からみて、こうした庇護を求める権利とも考えられ、その点からは亡命権ともいいうる。
