Gambling crime

Gambling, that is, the crime of gambling or being involved in it. Speculation is a kind of human instinct, and gambling is widely practiced as a daily entertainment for the common people, but it cannot be denied that if it goes beyond the boundaries of common entertainment and one dreams of getting rich in one go or becomes addicted to gambling, it can lead to a loss of motivation to work and even the breakdown of one's family. Therefore, the current Criminal Code establishes the crime of gambling, and provides for a fine or petty fine of up to 500,000 yen, imprisonment of up to three years for habitual gambling, and imprisonment of three months to five years for those who operate a gambling hall or join gamblers in order to gain profits (Articles 185 and 186 of the Criminal Code).

However, while public gambling such as horse racing, bicycle racing, boat racing, and auto racing is widely recognized, it is not realistic to punish small gambling activities widely practiced by ordinary people, such as the casual gambling habit of mahjong, under this crime. Therefore, in practice, the crackdown and punishment of simple gambling in particular is not thorough.

賭博、すなわちギャンブルをしたり、これに関与する罪。射幸心は人間の一種の本能であり、賭(か)け事は庶民の日常的な娯楽として広く行われているが、庶民的な娯楽の境を越え一攫(いっかく)千金を夢みたり、賭け事に熱中すると、労働意欲が失われ、家庭崩壊にもつながるおそれがあることも否定できない。そこで、現行刑法は賭博罪を設け、50万円以下の罰金または科料に処するとともに、常習的に賭博をすれば3年以下の懲役に、賭博場の開帳や博徒の結合により利益を図る行為をすれば3月以上5年以下の懲役に処している（刑法185条、186条）。

　しかし、競馬、競輪、競艇、オートレース等の公営ギャンブルを広く公認しながら、たとえば非常習的な賭け麻雀(マージャン)など広く行われている庶民のささやかな賭け事をも本罪により一律に処罰することは実情にあわない。そこで、実務上も、とくに単純賭博については取締りや処罰が徹底しているわけではない。
