Political prisoner
Crimes that violate the politics and order of the nation. Also known as state crimes. Not only crimes with political overtones such as treason, but also crimes such as murder can become a criminal offense if they are committed with the intent of disrupting national politics. In criminal law, many criminal offenses are committed with the intention of knowingly committing them, so special consideration is required. Trials for criminal offenses must be made public (Article 82 of the Constitution). Article 2 of the 1953 Extradition Law stipulates that fugitives shall not be extradited if they are a political crime or if the request for extradition is deemed to have been made for the purpose of trying or executing a punishment for a political crime.

国家の政治,秩序を侵害する犯罪。国事犯とも。内乱罪のように政治的色彩をもっているものだけに限らず,殺人罪などでも国政を紊乱(びんらん)する目的で犯されれば本罪になる。刑事学上本罪は多く確信犯であるために特別の配慮が必要。本罪についての裁判は必ず公開されなければならない(憲法82条)。逃亡犯罪人引渡法(1953年)第2条は,政治犯罪であるとき,または引渡しの請求が政治犯罪について審判しあるいは刑罰を執行する目的でなされたものと認められるときは,逃亡犯罪人を引き渡してはならないとする。
