Promulgation - Koufu

The act of making new laws that have already been enacted widely available to the general public. The Constitution of Japan states that the promulgation of constitutional amendments, laws, cabinet orders, and treaties is a state act of the Emperor (Article 7, item 1). For other legal forms, the enacting body may or may not be the promulgating body, and there is no uniformity. There are no general provisions in law regarding the method of promulgation of laws, but it is customary to do so by publishing it in the Official Gazette. Laws come into effect when they are enacted, but promulgation is a requirement for their implementation. In principle, laws come into effect a certain date after promulgation, but there are many cases where they come into effect at the same time as they are promulgated. There are restrictions on the time of promulgation of laws and ordinances (Diet Law 65, 66, Local Autonomy Law 16).

すでに成立した新しい法令を広く一般人が知ることができる状態におく行為。日本国憲法は，憲法改正，法律，政令および条約の公布を，天皇の国事行為としている (7条1号) 。これ以外の法形式については，制定機関が公布機関であることも，またそうでない場合もあり，必ずしも一定しない。法令公布の方式について一般的に定めた法律の規定はないが，官報に載せることによって行う慣例になっている。法令は施行によって現実に効力を発するが，公布は施行の要件である。法令は公布より一定期日後施行されるのが原則であるが，公布とともに施行される場合も少くない。法律と条例の公布時期については制限がある (国会法 65，66，地方自治法 16) 。
