In a broad sense, it generally refers to a dispute between national or local government agencies over the existence of authority regarding a certain matter or case. When both parties assert the existence of their own authority, it is called a positive authority dispute, and conversely, when both parties deny their own authority, it is called a negative authority dispute. The system of authority disputes (Kompetenzkonflikt in German, conflit d'attribution in French) originally developed mainly in France and other German-speaking countries as a system to resolve conflicts of positive or negative authority between judicial and administrative agencies of different systems that arose as a result of the separation of judicial and administrative jurisdictions with the adoption of the administrative court system. 広義では,一般にある事項または事件について国または地方公共団体の機関相互間で生じた権限の存否をめぐる紛争をいう。双方がともに自己の権限の存在を主張する場合を積極的権限争議といい,逆に,双方がともに自己の権限を否定する場合を消極的権限争議という。 権限争議(ドイツ語でKompetenzkonflikt,フランス語でconflit d’attribution)の制度は,元来,行政裁判の制度の採用により司法裁判(司法権)と行政裁判(行政権)とが分離され,その結果生じた系統の異なる司法・行政両裁判機関相互間の積極的または消極的な権限の抵触・衝突を解決するための制度として,主としてフランスおよびドイツ系諸国において発達してきた。
