Along with judgments and orders, it is a type of judgment made by a court. (1) In civil litigation, judgments are used as a form of final or interim judgment on a lawsuit, while decisions and orders are used as a form of judgment on matters related to the direction of litigation, disposition of incidental matters, or enforcement. Procedurally, while oral argument is required for a judgment, oral argument is optional for decisions and orders (Civil Procedure Code). In addition, notice of oral argument can be given in a manner deemed appropriate, and a written court document can be substituted by a record of the proceedings. (2) Decisions in criminal litigation are almost the same. However, except in cases such as petitions in court, there is no need to hear the statements of the parties involved, and there is no need to give reasons for decisions that do not allow an appeal. However, decisions in the Criminal Procedure Code are also used for dismissal of prosecutions, appeals, and appeals to the Supreme Court (Criminal Procedure Code).

判決および命令とともに裁判所のする裁判の一種。 (1) 民事訴訟上，判決は，訴訟についての終局的または中間的判断の形式として用いられるが，決定および命令は，訴訟指揮ないし付随的な事項の処分，あるいは強制執行に関する事項の裁判の形式として用いられる。手続的な面においても，判決をするにあたっては，必ず口頭弁論を経なければならないのに対し，決定および命令については，口頭弁論を開くかどうかは任意的である (民事訴訟法) 。また，その告知も相当と認める方法ですれば足り，裁判書をつくらず調書の記載で代用できる。 (2) 刑事訴訟上の決定もほぼ同じである。ただし，公判廷での申し立てなどの場合以外は関係人の陳述を聞く必要はなく，抗告の認められない決定については理由を付する必要もない。もっとも刑事訴訟法上の決定は公訴，控訴，上告の棄却についても用いられる (刑事訴訟法) 。
