Request for dismissal - kaishokuseikyuu

A system in which the public (residents) can dismiss public officials for reasons that go against the public will. The Constitution of Japan recognizes this right to select and dismiss public officials as an inherent right of the people (Article 15, Clause 1). The Local Autonomy Law, which embodies this, provides that residents have the right to request the dismissal of important appointed positions such as vice governors, deputy mayors, election management committee members, audit committee members, public safety committee members, and education board members, in addition to elected positions such as assembly members and mayors of ordinary local public entities (Article 13, Clauses 2 and 3). In addition, individual laws provide for the right to request the dismissal of agricultural committee members, members of marine district fisheries adjustment committees, and general representatives of land improvement districts.

国民（住民）の意思に反することを理由として、国民（住民）が公務員の地位にある者を罷免する制度。日本国憲法は、このような公務員の選定罷免権を国民固有の権利と認めている（15条1項）。これを具体化した地方自治法は、普通地方公共団体の議会の議員および長の公選職のほか、副知事、副市町村長、選挙管理委員、監査委員、公安委員会の委員および教育委員会の委員といった重要な任命職についても、解職請求を住民の権利としている（13条2項、3項）。そのほか個別法により、農業委員、海区漁業調整委員会の委員および土地改良区の総代の解職請求が定められている。
