…The Japanese military court system was modeled on the French system, and the French term conseil de guerre was translated as military court. The military court system in France at that time had been in place since 1857, and consisted of the following: (1) the trial was conducted by an officer of the same rank as the defendant, in the spirit of a jury; (2) appeals against military court decisions could be made to the Supreme Court of Cassation in peacetime and to the Supreme Court of War in wartime; (3) in the navy, a naval court was established before military courts to try crimes committed by civilians that were prejudicial to the peace of naval ports and arsenals. In 1882, the military court was abolished and a military court was established in Tokyo, and in 1883, it was institutionalized by the Army Criminal Law. …
