Family inheritance - Kazokuseshuzaisan (English spelling) Familienfideikommisse [Germany]
This refers to property that is permanently restricted by legal act and that is usually designated to be inherited by certain people according to a certain order of succession. It originated in Spain, was introduced to Italy and Austria in the 16th century, and was adopted in Germany after the Thirty Years' War (1618-48), and spread to Scandinavia and the Balkans. In Germany, joint inheritance had been practiced since ancient times, and there was a risk that inheritance would be divided among the heirs, so the nobility struggled to maintain the land and other property that was the basis of their political and social power. Since the 14th century, the higher nobility achieved their goal of maintaining their property by prohibiting the disposal of their property through family constitutions and making it a single inheritance.

法律行為によって永久に処分を制限され,通常,一定の相続順位によって一定の者が相続すべきことを定められた財産をいう。その起源はスペインにあり,16世紀にイタリアおよびオーストリアにはいり,三十年戦争(1618‐48)後ドイツに行われるにいたり,スカンジナビアおよびバルカン方面にも広まった。ドイツでは古くから共同相続が行われ,相続財産は相続人の間に分割される危険を蔵していたから,貴族たちはその政治的・社会的勢力の基礎である土地その他の財産の維持に苦心し,高級貴族は14世紀以来家憲によってその財産の処分を禁止し,これを単独相続とすることによって,財産維持の目的を達した。
