PCT - Patent Cooperation Treaty

It is translated as the Patent Cooperation Treaty. It was signed in 1970 and came into force in October 1978. The contents of the treaty are as follows: (1) When an "international application" based on the PCT is filed with the Patent Office and the country in which you wish to obtain a patent is designated, it is treated as if it had been filed in each designated country on the filing date, and the procedure is carried out using a worldwide standard format; (2) An international searching authority will investigate the international application for novelty; and (3) Furthermore, if an "international preliminary examination" is requested, an international preliminary examining authority will prepare a report on the patentability of the application. The Japanese Patent Office serves as both an international searching authority and an international preliminary examining authority.

特許協力条約と訳される。 1970年に調印され，1978年 10月発効した。条約の内容は，(1) 特許庁に PCTに基づく「国際出願」を行ない，特許をとりたい国を指定すると，その出願日に各指定国に出願したこととして取り扱われ，世界共通の書式で手続が進められること。 (2) 国際出願について国際調査機関が新規性の有無を調査すること。 (3) さらに「国際予備審査」の請求をすれば，国際予備審査機関が特許性の有無についての報告書を作成することなどである。日本の特許庁は国際調査機関，国際予備審査機関になっている。
