Fuekiho - Unchanging Law

Japanese: 不易法 - ふえきほう

It can also be used to mean a fundamental law that has remained unchanged throughout history, but it usually refers to medieval law that stipulates that judgments made prior to a certain period be given formal finality. The Kamakura Shogunate Law includes (1) the provisions of the preface and Article 7 of the Goseibai Shikimoku (Code of Punishment for Trials and Appeals) for judgments made during the reigns of the 3rd Shogun and Hojo Masako, (2) the December Law of 1258 (Shoka 2) for the period from 1225 (Karoku 1) to 1242 (Ninji 3) during the reign of Hojo Yasutoki, (3) the August Law of 1271 (Bun'ei 8) for the period from 1243 (Kangen 1) to 1256 (Kōgen 1) during the reign of Hojo Tsunetoki and Tokimune, and (4) the September Law of 1290 (Shoō 3) for the period from 1256 to 1884 (Kōan 7) during the reign of Hojo Nagatoki, Masamura, and Tokimune. In (4), judgments that were only six years old were made immutable, and the filing of appeals to other courts was denied, which is thought to reflect the aversion of the Hojo Regent's power to the system of appeals to other courts.

古今を通じて不変の基本法という意味にも用いられるが，普通は一定時期以前の判決に形式的確定力を付与することを定めた中世法をさす。鎌倉幕府法では，(1)3代将軍と北条政子時代の判決に対する《御成敗式目》前書と第7条の規定，(2)北条泰時執権期の1225年(嘉禄1)から42年(仁治3)までに対する58年(正嘉2)12月法，(3)北条経時･時頼時代の43年(寛元1)から56年(康元1)に対する71年(文永8)8月法，(4)北条長時･政村･時宗時代の56年から84年(弘安7)に対する90年(正応3)9月法があり，(4)に至って，わずか6年を経たにすぎない判決を不易化し，越訴（おつそ）の提起を否認したことは，越訴制に対する北条得宗権力の嫌悪が反映したものと考えられている。
