This refers to an appeal against a trial or a decision made by a prosecutor or judicial police officer.

Quasi-appeal in civil litigation

An objection is a complaint filed by a party who is dissatisfied with the judgment of a commissioned or commissioned judge to the court in which the case is brought (Article 329, Paragraph 1 of the Civil Procedure Code). If the party is dissatisfied with the judgment of the objection, an appeal can be filed (Article 329, Paragraph 2 of the same Code). This objection is permitted only for cases where the judgment could be appealed if it were a judgment of the court in which the case is brought (for example, fines for failure to appear at a witness examination, judgments for refusal to testify, and sanctions). The court in which the case is brought makes a decision on the objection, but appeals against this decision are governed by general provisions. If the court in which the case is brought is the Supreme Court or a High Court, it is not possible to appeal against that decision (Article 7 of the Court Act), so Article 329, Paragraph 3 of the Civil Procedure Code was established to ensure that there is no lack of rights relief. In other words, if the judgment is one that could be appealed if it was made in a district court, an objection can be filed to the court in which the case is brought. However, an appeal against this judgment of the objection can no longer be filed.

Quasi-appeal in criminal proceedings

It is a petition made by a person who is dissatisfied with a decision to dismiss a petition for recusal made by a judge, a decision to return detention, bail, seizure, etc., or a decision to order detention for an expert opinion (Article 429, Paragraph 1 of the Code of Criminal Procedure), or a decision made by a public prosecutor, public prosecutor's assistant, or judicial police officer regarding the designation of a meeting time between a suspect and his/her defense attorney, or the seizure or return of seized items (Article 430 of the Code). Such a petition can be filed with the court to which the judge belongs (the competent district court in the case of a judge of a summary court), or the court corresponding to the public prosecutor's office to which the judge belongs, or the court with jurisdiction over the place where the judicial police officer performs his/her duties, requesting the cancellation or modification of the decision or decision. To make such a request, a petition must be submitted to the competent court (quasi-appellate court) (Article 431 of the Code).

民事訴訟における準抗告

受命裁判官または受託裁判官の裁判について不服がある当事者が、受訴裁判所に申し立てる異議のこと(民事訴訟法329条1項)。そして、その異議の裁判に対して不服があれば抗告ができるものとしている(同条2項)。この異議は、その裁判が受訴裁判所の裁判であれば抗告をなしうるもの(たとえば、証人尋問への不出頭に対する過料、証言拒絶についての裁判、および制裁など)に限って許される。異議について受訴裁判所は決定で裁判するが、この決定に対する抗告は一般の規定による。最高裁判所または高等裁判所が受訴裁判所である場合は、その裁判に対して抗告することができないので(裁判所法7条)、権利救済に欠けることのないように民事訴訟法第329条3項が設けられている。すなわち、地方裁判所でなされたならば抗告できる裁判であるときは、受訴裁判所に対し異議を申し立てることができるものとした。なお、この異議の裁判に対しては、もはや抗告はできない。

刑事訴訟における準抗告

裁判官がなした忌避の申立てを却下する裁判、勾留(こうりゅう)・保釈・押収等の還付に関する裁判、鑑定のため留置を命ずる裁判など(刑事訴訟法429条1項)、または検察官・検察事務官もしくは司法警察職員がなした被疑者と弁護人の接見時間の指定、押収もしくは押収物の還付に関する処分(同法430条)に対して、不服のある者がする申立てをいう。その不服申立ては、当該裁判官所属の裁判所(簡易裁判所の裁判官のときは管轄地方裁判所)または所属検察庁に対応する裁判所もしくは司法警察職員の職務執行地を管轄する裁判所に対して、そのなした裁判あるいは処分の取消しまたは変更を請求することができる。これらの請求をするには、請求書を管轄裁判所(準抗告裁判所)に差し出さなければならない(同法431条)。
