[Historical Background]
As the Code of Hammurapi, said to date back to the 17th century BC, already contained detailed provisions on the liability of doctors who failed to provide medical care, medical care became subject to legal regulation as it became part of society. However, it was not until the beginning of the 19th century, when the term medical jurisprudence, which includes issues related to modern-day forensic medicine and sanitation administration, began to appear, that such legal regulations began to take shape. This was against the backdrop of the fact that the regulation of the status of doctors was transferred from the guilds to the state, and that dangerous materials, dangerous work, and urban sanitation issues became major concerns, as reflected in the Industrial Revolution.

 紀元前17世紀のものといわれるハンムラピ法典にすでに,医療を失敗した医師の責任について詳細な規定があることが示すように,医療が社会的に行われるようになるとともに医療は法規制の対象とされてきた。しかしそのような法規制が一つのまとまりをもちはじめたのは,19世紀初頭,現在の法医学や衛生行政などに属する問題をふくめた医事法制medical jurisprudenceという用語が散見されはじめたころである。医師の身分規制がギルドから国家の手に移り,産業革命という言葉に表されるように危険物・危険業務,また都市衛生問題が重大関心事となってきたことを背景とする。…
