A criminal privilege in ancient Japanese law. A type of atonement. It is given to a certain range of relatives of the Emperor, the three Empresses, those who have received special treatment from the state, and those who have received the seventh rank or sixth class of the Order of Mercy or higher. If such a person commits a crime punishable by exile or less, they are permitted to substitute a bronze atonement for their actual imprisonment. However, if they commit a serious crime such as the fifth exile, or if the person who has received the atonement harms the person who provided it, they are excluded from the scope of atonement. 日本古代の律における刑事上の特典。贖罪の一種。天皇,三后,国家から特別の処遇を受けた者,七位・勲六等以上を有する者の,それぞれ一定範囲の親族に対して与えられる。それらの者が流罪以下を犯した場合,贖銅をもって実刑に代えることが許される。ただし五流等の重罪を犯した場合,また受蔭者が施蔭者本人に害を加えた場合等は,蔭贖の対象から除外される。詳細は養老の名例律に規定されるが,その淵源は唐律に由来する。【小林 宏】
