Abuse of rights - Kenriranyou

Japanese: 権利濫用 - けんりらんよう

It refers to a state in which the exercise of rights deviates from its legitimate scope and is not recognized as a legitimate exercise of rights. Under the Civil Code, the abuse of rights is prohibited. In other words, the exercise of rights must be socially appropriate. If the exercise of rights is recognized as an abuse, the exercise of rights will not have any effect, and instead the abuser may be obligated to pay damages, or in some cases the abuser may lose his or her rights. This principle of prohibiting the abuse of rights had been recognized by case law before World War II, but based on the results of case law, the Civil Code was revised in 1947 to include the explicit statement that "abuse of rights shall not be permitted" (Article 1, Paragraph 3).

権利の行使にあたってその正当な範囲を逸脱し，正当な権利の行使とは認められない状態をいう。民法上，権利の濫用は禁止されている。つまり権利の行使は社会的にみて妥当とされるものでなければならない。権利の行使が濫用と認められたときは，権利行使の効果は生じないで，逆に濫用者自身に損害賠償義務が生じたり，場合によっては濫用者がその権利を失うこともある。この権利濫用禁止の法理は，第2次世界大戦前から判例によって認められていたが，判例の成果をふまえて 1947年の民法改正により「権利ノ濫用ハ之ヲ許サス」という明文が設けられた (1条3項) 。
