Pursuant to the provisions of Article 4 of the Air Pollution Control Act, Article 3, Paragraph 3 of the Water Pollution Control Act, and Article 4, Paragraph 2 of the Noise Regulation Act, municipalities and other local governments impose standards by ordinance that are stricter than the national uniform standards. Article 29 of the Water Pollution Control Act also states that local governments may regulate by ordinance any pollution conditions other than those specified by law (excluding harmful substances) and any facilities other than the facilities specified by law (specific business establishments with specific facilities). 大気汚染防止法 4条,水質汚濁防止法 3条3項,騒音規制法4条2項の規定により,市町村などの自治体が,条例によって課す,全国一律の規制基準よりきびしい基準をいう。なお,水質汚濁防止法 29条には,法律の定める汚染状態 (有害物質を除く) 以外の汚染状態について,また法律の定める規制対策施設 (特定施設を有する特定事業場) 以外の施設についても,いずれも条例で規制することができるとしている。これを横出し基準という。
