In criminal proceedings, circumstantial evidence is evidence that proves facts (indirect facts) that indirectly infer the existence of a criminal fact. It is generally called circumstantial evidence. It is contrasted with direct evidence. For example, in a murder case, the testimony of a witness who witnessed the murderer putting poison into food is direct evidence, but the testimony of a pharmacy owner that he sold the poison to the murderer is indirect evidence of the murder. The distinction between direct evidence and indirect evidence is based on whether the subject of proof is the main criminal fact or an indirect fact, and there is no difference in probative value between the two types of evidence. 刑事訴訟において犯罪事実の存在を間接的に推測させるような事実 (間接事実) を証明する証拠をいい,一般に情況証拠ともいわれる。直接証拠と対比される。たとえば,殺人事件で犯人が毒物を食物に混入する現場を目撃した証人の証言は直接証拠となるが,犯人に対し毒物を販売した旨の薬局店主の証言は殺人事実の間接証拠となる。直接証拠と間接証拠との区別は,証明の対象が主要事実たる犯罪事実か,それとも間接事実かの相違によるもので,両証拠の間に証明力上の差異が認められるわけではない。
