This law stipulates the registration, rights, and protection of designs. When consumers purchase a product, the important points are the shape, pattern, and color. Since designs are important elements of industrial products, they are protected as design rights, subject to application and examination. In order to strengthen intellectual property protection, the law was revised in June 2006 to extend the period of rights from 15 years to 20 years, and the design of the operation screen of information appliances such as video equipment was added to the scope of protection. If a design can be used industrially, not only the whole of an item but also a certain part of it can be protected as a partial design, but it must be inseparably related to the industrial product. There are also unique measures, such as the secret design system, which allows a design to be kept secret for three years after registration, taking into account the release date of the related industrial product, as is the case with automobile designs. On the other hand, design rights are vulnerable to infringement, and injunctions are often issued under the Unfair Competition Prevention Act in terms of effectiveness.

意匠(デザイン)の登録、権利内容、保護を定めた法律。消費者が商品を購入する際に重要なポイントとなるのは形や模様、色などである。意匠は工業製品の重要な要素であることから、出願、審査を前提として意匠権として保護される。知財保護強化の観点から、2006年6月の法改正では、その権利期間が15年から20年間へ延長されたほか、ビデオ機器などの情報家電の操作画面のデザインも保護対象に追加された。意匠は工業上利用できるものであれば、物品全体だけでなく、ある一部分だけでも部分意匠として保護されるが、工業製品と不可分な関係でなければならない。また、自動車のデザインなどが好例だが、関連する工業製品の発売時期を考慮して、登録から3年以内はその意匠を非公開にできる秘密意匠制度など、独特な措置もある。一方、意匠権は侵害に弱い面があり、侵害に対しては実効性の観点から、不正競争防止法による差し止めを行う例が多い。
