A right derived from copyright. In order to translate a work, permission to do so must be obtained from the copyright holder. In Japan, when translating works from member countries of the Berne Convention (1886) into Japanese, the translation right expired after 10 years, and the work could be freely translated and published in Japan if a legal translation was not published in Japanese within 10 years of its publication. This system was adopted to protect Japanese publishers, but after criticism from other countries, the current Copyright Act (Act No. 48 of 1970) provisionally allowed the right to expire only for works published before 1970. As a result, since 1981, the translation right no longer expires after 10 years, and, like copyright, it now lasts for 50 years after the death of the author. Regarding the translation into Japanese of works from member countries of the Universal Copyright Convention (1952), a seven-year compulsory licensing system for translation rights applies, which means that no translation may be published without the permission of the copyright holder for seven years after the publication of the work. However, after that date, anyone may obtain permission for translation from the Commissioner of the Agency for Cultural Affairs by paying a reasonable remuneration that conforms to international practice.
